The Visa Specialist will administer policies based on federal and state immigration regulations and develop, implement, and perform procedures to ensure compliance including internal controls, management reports, and other tools; Resolve complex problems and answer questions about federal and state employment regulations; Make formal and informal presentations to administrators, faculty, staff, and students; Provide excellent customer service and training to departmental human resources liaisons, administrators, and employees. Actively participate with colleagues in various departments to ensure University compliance with federal laws surrounding immigration, payment, and grant processing and to help customers resolve problems and improve processes to meet or exceed customer expectations.

Interpret and advise upper management on complicated federal income laws, tax treaties, labor and immigration laws, and regulations; Responsible for maintaining an ongoing examination of all MSU’s foreign employees using Internal Revenue Service (IRS) guidelines and regulations; Work directly with Non-Resident Aliens (NRAs) or Resident Aliens (RAs) claiming exemption from income taxes and who are in the U.S. performing duties as described by tax treaties between their country of residence and the U.S. (form 8233 and/ or W-9).

Maintain effective working relationships with departmental administrators and individuals to resolve tax issues, by advising departments and employees on withholding rules for non-resident aliens; Provide instruction and guidance to visiting students and scholars.

Meet with each foreign employee as part of new employee orientation to ensure that residency data is correct to determine the eligibility for treaty benefits. Sign the I-9 Form for employees, and verify all foreign documents prior to signing the I-9 (visa, passport, I-94, I-20, DS-2019, EAD cards, and or Green Cards). Responsible for maintaining the visa-related data in HRIS. Audit all NRA’s, RAs, and Permanent Residents (PRs) W-4 forms. Determine whether a foreign individual is an NRA or RA for tax purposes which include Federal income tax withholding, Social Security, and Medicare taxes. Review and verify employment eligibility on all U.S. Citizenship Immigration Services (USCIS) documents to ensure that the University complies with Federal employment laws, and provide instructions to NRAs on how to complete forms properly.

Establish, implement, and maintain processes for payments to non-resident aliens made through the Payroll system. Manage and coordinate all non-resident alien payroll issues. Assist with verifying totals, processing, and distribution of W-2’s; Review research and implement all federal policy changes affecting NRAs employment and taxation.

The successful candidate must have a HS Diploma or GED. Two (2) years of related experience is required.

Candidates with a Bachelor’s Degree in Business, Human Resources, Psychology, Communications or related field may receive preference.
